1. Lawful use
You may use XORVANIQ services only for lawful purposes and in a manner consistent with these policies, the accepted order, third-party licences and the rights of others. You may not use the service to facilitate conduct that you know or reasonably should know is unlawful.
2. Unauthorized access and security abuse
- No unauthorized access, exploitation, credential stuffing, password spraying, account takeover, privilege escalation or bypass of access controls.
- No scanning, probing or exploitation of systems you do not own or have explicit authorization to test.
- No distribution, hosting or operation of malware, ransomware, botnets, credential stealers, phishing kits, malicious loaders or command-and-control infrastructure.
- No deliberate concealment of attack traffic, origin spoofing or use of XORVANIQ infrastructure to coordinate attacks against third parties.
3. Network abuse and disruption
Do not intentionally create denial-of-service traffic, reflection/amplification abuse, routing attacks, abusive port scans, network floods or other activity that materially degrades shared infrastructure, upstream networks or another customer’s service.
Open relays, publicly exploitable proxies, insecure recursive resolvers and similar high-abuse configurations may be blocked or restricted. Port 25 and other ports or protocols associated with significant abuse may be filtered unless a legitimate use is specifically approved.
4. Email, messaging and communications
You may not send spam, unsolicited bulk commercial messages, deceptive messages, forged sender information, phishing or harassment. Commercial electronic messaging must comply with applicable consent, identification and unsubscribe requirements, including Canada’s anti-spam rules where they apply.
Mailing lists must use lawful address collection and reasonable list hygiene. Purchased, scraped or harvested recipient lists are prohibited where their use would violate law or create abusive messaging.
5. Harmful, exploitative and abusive content
You may not use services to knowingly host or distribute content whose possession or distribution is unlawful, including child sexual abuse material, non-consensual intimate imagery where prohibited, credible threats, trafficking material, or content intended to facilitate serious violence or exploitation.
Harassment, doxxing, stalking or publication of highly sensitive personal information for the purpose of causing harm may result in restriction or suspension.
6. Copyright, trademarks and third-party rights
You must have the rights or permissions required for content, software, game files, media, domains and trademarks you use. Do not knowingly use XORVANIQ services for copyright piracy, counterfeit activity, licence circumvention or infringement of third-party rights.
Reports alleging infringement should identify the work or right involved, the affected XORVANIQ-hosted location, the reporter’s authority and reliable contact information so the report can be reviewed.
7. Privacy and personal information
Do not collect, expose, sell, trade or misuse personal information in violation of applicable privacy law. Customers operating applications that collect personal information are responsible for appropriate notices, permissions, safeguards, access controls and retention practices for their own users.
8. Resource abuse and prohibited workloads
Use resources within the limits of the accepted service. Workloads that create sustained excessive CPU, memory, disk, bandwidth, connection or storage pressure may be rate-limited, migrated, suspended or require a different plan. Cryptocurrency mining, public scanning infrastructure, anonymizing exit services, bulk scraping, high-volume relays and similar high-risk workloads may be restricted or require prior written approval.
9. Game hosting and software licences
Game servers must comply with the applicable publisher, platform, mod, anti-cheat and commercial-hosting rules. Customers are responsible for game ownership, server keys, paid licences and permissions that the publisher requires. Do not use hosted game services to distribute cheats, malware, stolen accounts or unauthorized copyrighted game files.
10. Authorized security testing
Security testing is allowed only against systems you own or have explicit permission to test. Testing must stay within the authorized scope and must not materially affect shared systems, other customers or upstream networks. Coordinated testing of XORVANIQ infrastructure itself requires prior written authorization.
11. Enforcement
XORVANIQ may investigate credible abuse reports and use proportionate measures such as rate limits, port blocks, content isolation, temporary suspension or termination. Urgent action may be taken without advance notice when reasonably necessary to contain an active attack, compromised service, unlawful material, safety risk or serious platform threat.
Where practical and appropriate, we will provide notice and an opportunity to correct less urgent violations. Repeated or deliberate violations may result in termination.
12. Abuse reports and legal requests
Send abuse reports to abuse@xorvaniq.ca. Include the affected hostname, IP address or URL, timestamps with timezone, a concise description, supporting evidence and a reliable contact address. Do not send passwords, private keys or unrelated personal information.
Law-enforcement or legal requests should clearly identify the requesting authority, legal basis, records sought and a contact for verification. XORVANIQ may require proper legal process before disclosing customer information unless an applicable emergency exception or law requires otherwise.
13. Monitoring and cooperation
This policy does not create a general obligation for XORVANIQ to monitor all customer content or traffic. We may use security and operational telemetry reasonably necessary to operate services, investigate abuse and protect the platform, consistent with the Privacy Policy.
Customers should cooperate with reasonable abuse-remediation requests and preserve relevant logs when an investigation requires them.
14. Changes
We may update this policy as threats, services and legal requirements change. Material changes affecting existing paid services will be communicated through a reasonable channel where required. The current effective date will always be published here.
Regional addendum — United States
Regional status. United States is a PILOT / CANADA REGION. XORVANIQ does not claim a local office, local legal entity, or dedicated infrastructure in this region unless a later published status page expressly says otherwise.
Currency. Regional pages may show USD pilot estimates converted from the CAD catalogue. Until fixed regional prices or local-currency checkout are expressly enabled, the accepted order or checkout confirmation controls the final currency and amount.
Tax. U.S. sales-tax handling is being configured state by state. Paid regional checkout stays gated until applicable nexus, taxability and registration rules are accepted. XORVANIQ will not describe a tax as collected or registered until the required registration/configuration is actually active.
Privacy. State privacy rights may apply depending on the customer state, processing activity and statutory thresholds. XORVANIQ will honour applicable non-waivable rights and publishes privacy@xorvaniq.ca for requests.
Governing law and forum. The contracting entity remains XORVANIQ Solutions in Ontario, Canada. The agreement is governed by Ontario law and applicable federal law of Canada. Subject to any mandatory non-waivable right to another forum, disputes must be brought in the courts having jurisdiction in Ontario, Canada.
Mandatory rights. Nothing in this regional addendum removes consumer, privacy, tax, payment or other statutory rights that applicable law says cannot be waived.
The Acceptable Use Policy applies together with applicable laws in the customer location. Regional law does not authorize activity that would otherwise violate XORVANIQ security, abuse, intellectual-property or network-protection rules.
